Casa Del Sol

Residency Waiver

1. I will be participating in yoga classes, aerial silks classes, fire flow arts, healing ceremonies, workshops and other exercises that may require a high level of physical, mental, and emotional activity and exertion. I assume all inherent risks of these actions, and will in no way hold Renee Guay, Peter John Swartz II, Higher Flow, Casa Del Sol owners/property managers, or their consultants accountable for any accidents, damages, illnesses or injuries that may occur as a result of my participation in the residency and its corresponding events.

2. I understand that it is my responsibility to consult a medical professional prior to the residency, and make sure that I am capable and prepared for consecutive days of physical, mental, and emotional activity.

3. I understand that this residency takes place in the jungles of Mexico and as a result, I may be far from medical professionals. In the instance of injury, there may be the necessity for the assistance of a first responder, and serious events may require a Helicopter Medi-Flight. If this is the case, I will be responsible for any costs incurred.

4. In consideration of being permitted to participate in the programs, I agree to assume full responsibility for any risks, conditions, loss, damages, or injuries that may occur while taking part in the Casa Del Sol Residency Experience.

5. I knowingly, willingly, and expressly waive any claim that I may have against Higher Flow instructors, staff, and owners/property managers of Casa Del Sol for any injury, damages, or death that may occur while staying at Casa Del Sol and participating in any events.

6. I release Higher flow and all instructors, staff, and owners/property managers of Casa Del Sol from any and all liability, claim, demand or action that I may have related to the loss, theft, or damage of any personal property while attending the retreat, both in and out of Casa Del Sol.

7. I understand that it is my responsibility to inform the facilitators of any injury that may occur during the event, so necessary action can be taken immediately.

8. Higher Flow will not be held responsible for the failure of any travel services, such as flights, transportation to Mexico, or the use of local taxi services. All instances of transportation are my sole responsibility.

9. I hereby grant permission to Renee Guay, Peter John Swartz II and Higher Flow for the rights of my image or likeness, without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published, or distributed, and I waive the right to inspect or approve of any finished product wherein my likeness appears. Additionally, I waive the right to any royalties or compensation related to the use of my image or recording. I understand that this means my image or video may be electronically displayed anywhere, internationally, in public, private, or educational settings. There is no time limit on the validity of this release, and I will not be consulted about the use of these medias.

10. Higher Flow, Renee Guay, and Peter John Swartz II will not accept responsibility, or pay any compensation as a result of any events that result in the destruction or damage of your accommodation or anything else. Such events include, but are not limited to fire, explosion, flood, storm or other weather damage, break-in, theft, criminal damage, riots or civil strife, war or threat of war including terrorist activity, industrial action, natural disasters, epidemic, negligence, personal destruction of the event facility/accommodations and other situations beyond our control. As a result, I will be responsible for any costs of possible relocation.

11. My heirs, or legal representatives, forever release, waive, and discharge claims of negligence or incompetence against Higher Flow, Casa Del Sol and their correspondents.
